Terms of Use for Newsletter Signup Form
Bilizen Co., Ltd. (hereinafter referred to as the "Company") publishes newsletters regarding products, services, campaigns, and other business activities handled by the Company (hereinafter referred to as the "Newsletter"). This Terms of Use for Newsletter Signup Form (hereinafter referred to as the "Terms of Use") applicable to those who wish to subscribe to the Newsletter (hereinafter referred to as "Users") and to the Company.
1. Registration for distribution
In order to subscribe to the Newsletter, Users shall register to receive it by filling out and submitting this signup form prescribed by the Company. By submitting this signup form to the Company, Users agree to receive the Newsletter and to abide by all of the terms and conditions of the Terms of Use. Registration to receive and subscription to the Newsletter is free of charge. The Newsletter is distributed on an irregular basis.
2. Handling of Personal Information
The Company shall handle Personal Information provided by Users in accordance with the Act on the Protection of Personal Information and other relevant laws and regulations, as well as the Company's Privacy Policy , to which Users agree.
3. Unsubscribe from the Newsletter or change other registered information
If Users wish to unsubscribe from the Newsletter, please use the "Unsubscribe" link in the email the Company sends you.
If Users wish to change your e-mail address, please unsubscribe and then register again as described in Article 1. above.
If Users wish to make any other changes to your registration information, please use the "Update subscription details" link in the e-mail the Company sends you.
4. Cancellation of subscription
The Company reserves the right to cancel the registration and suspend the distribution of the Newsletter without prior notice to Users if any of the following occurs:
(i) In case of violation of the Terms of Use.
(ii) When there are falsehoods, errors or other deficiencies in the registration information.
(iii) If the Newsletter does not reach the registered e-mail address.
(iv) When the Company otherwise deems it inappropriate.
5. Termination of the Newsletter, etc.
The Company may suspend or terminate the distribution of the Newsletter or change the contents of the Newsletter without prior notice to Users.
6. Disclaimer of Liability
The Company does not guarantee and is not responsible for the following:
(i) The completeness, accuracy, truth, certainty, usefulness, fitness for a particular purpose, and any other matters relating to the Newsletter and the information contained herein.
(ii) Damages incurred by Users due to the use of or inability to use the Newsletter.
(iii) Malfunctions or damages caused to the equipment, software, Internet connection environment, etc. owned by Users in relation to the distribution of the Newsletter.
(iv) Damages incurred by Users or third parties due to problems between Users or between Users and third parties.
(v) Damages incurred by Users due to suspension or termination of distribution of the Newsletter or changes to the content of the Newsletter.
7. Copyrights and other intellectual property rights
Copyrights and all other intellectual property rights related to the text, images, videos and all other information distributed through the Newsletter (hereinafter referred to as the "Distributed information") belong entirely to the Company or third parties who have granted permission to the Company to use such information. Except as specifically permitted by law, Users may not reproduce, modify, transfer to other websites, printed materials, or other media, or otherwise use the Distributed information, in whole or in part, without the prior written consent of the Company.
8. Links to Third Party Websites
The Newsletter may contain links to websites controlled or operated by third parties. Use of linked websites is subject to the terms of use, privacy policy, and other arrangements of the third party that manages the linked website. Please be aware that the Company is not responsible for any damage or disadvantage incurred by Users in connection with your use of linked websites.
9. Prohibited acts
Users shall not do any of the following acts by yourself or by a third party when using the Newsletter. The Company reserves the right to immediately suspend distribution of the Newsletter if the Company determines that Users have violated any of these prohibitions:
(i) Any act of reproduction, transcription, or reusing of the Distributed information for commercial purposes beyond the scope of personal use.
(ii) Registering a third party's e-mail address without permission.
(iii) Acts that violate laws and regulations or public order and morals.
(iv) Acts of obstructing the distribution of the Newsletter or any other business of the Company by repeatedly making inquiries without justifiable reason or by any other means.
(v) Infringement on the intellectual property rights, portrait rights, publicity rights, honor, trust, privacy, or other rights or legally protected interests of a third party.
10. Modification of the Terms of Use
The Company may change the Terms of Use as it deems necessary in accordance with Article 548-4 of the Civil Code. In the event of modification of the Terms of Use, the Company will notify the public in advance of the modification, the content of the modified the Terms of Use, and the effective date of the modification by distributing the Newsletter or by other appropriate means.
11. Governing Law and Court of Jurisdiction
The Terms of Use shall be governed by and construed in accordance with the laws of Japan.
The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes arising between the Company and Users with respect to the Terms of Use or the Newsletter.
